1. Use of the Site

You may use the Site to learn about our services, request appointments, and communicate with our team. You agree to provide accurate information when submitting any form on the Site and not to use the Site for any unlawful purpose or in a way that could damage, disable, or impair it.

3. Appointments and Assessments

Requesting an appointment through the Site, including the $97 shoulder pain assessment, does not guarantee a confirmed appointment time until you receive confirmation from our team. We reserve the right to decline or reschedule a request at our discretion, including if we determine your condition is outside the scope of services we provide.

4. Fees and Payment

Fees for services, including the $97 assessment fee, are due at the time of service unless otherwise agreed in writing. We accept HSA/FSA payment where applicable; you are responsible for confirming your plan’s eligibility requirements.

5. Cancellations and No-Shows

We ask that you provide at least 24 hours’ notice if you need to cancel or reschedule your appointment. Cancellations within 24 hours will be assessed a $50 fee. Cancellations within 1 hour will incur full charge for services scheduled.

6. Text Message Communications

If you provide your phone number and opt in, we may contact you by text message regarding your appointment or inquiry. Message and data rates may apply. Reply STOP at any time to opt out. See our Privacy Policy for more detail.

7. Intellectual Property

All content on the Site — including text, graphics, logos, and images — is the property of True Health and Performance or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written permission.

8. Third-Party Links

The Site may contain links to third-party websites (such as a scheduling or payment platform). We are not responsible for the content, accuracy, or practices of any third-party site, and linking to it does not imply our endorsement.

9. Disclaimer of Warranties

The Site is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the fullest extent permitted by law, True Health and Performance shall not be liable for any indirect, incidental, special, or consequential damages arising out of or relating to your use of the Site. Nothing in these Terms limits liability for personal injury arising from professional negligence in the actual provision of physical therapy care, which is governed by applicable Missouri law and professional standards, not by this website disclaimer.

11. Indemnification

You agree to indemnify and hold harmless True Health and Performance and its owners, employees, and agents from any claims, damages, or expenses arising from your misuse of the Site or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be resolved in the state or federal courts located in Missouri.
